and the ticket purchaser.
The presentation of events and tickets on luma.com does not yet constitute a binding offer. The ticket purchaser only makes a binding offer to purchase a ticket by clicking the “Join Request” button for events requiring approval or the “Get Ticket” button and then entering their credit card details and clicking the “Pay by Card” button. Confirmation of receipt of the order is sent automatically by email after approval, or immediately after submitting the order for events that do not require organizer approval, and does not yet constitute acceptance of the contract. The contract is only concluded upon receipt of an express declaration of acceptance (e.g., a confirmation email with the attached ticket).
The contract language is German. The contract text is not stored permanently after conclusion of the contract. Ticket purchasers can save or print the order details immediately after submitting the order.
By purchasing a ticket or confirming registration for a free event, you acquire the right to participate in the event specified on the ticket.
2. Prices, Payment, and Delivery Conditions
All ticket prices are inclusive of statutory VAT and any applicable service or shipping fees.
Payment is due immediately upon conclusion of the contract and can be made using the payment methods offered during the ordering process.
Tickets are delivered exclusively electronically via email (e-ticket) to the email address provided by you. Postal delivery is only provided if explicitly agreed upon in individual cases.
3. Role of the Organizers
Diesdas.digital GmbH, as the organizer, provides the venue and handles the organizational aspects (e.g., ticket sales, communication).
The content, execution, and management of the event are the responsibility of the respective speakers and leaders. The organizer assumes no liability for content, procedures, or the quality of the conveyed material.
4. No Right of Withdrawal
According to § 312g (2) No. 9 BGB, contracts for the provision of services related to leisure activities, where the contract is for a specific date or period, do not grant a statutory right of withdrawal. Therefore, ticket purchases are binding and cannot be returned or refunded, unless otherwise stated in these terms and conditions.
5. Admission
Admission is only permitted for registered participants with a valid ticket. The ticket must be presented at the entrance. Unauthorized reproduction or resale of tickets is prohibited.
5a. Ticket Transfer
Tickets may be transferred to another person only after prior written agreement with the organizers (via email to: [email protected]), e.g., in case of illness. The transfer must take place no later than two days before the start of the event and requires the organizers’ approval. There is no entitlement to a transfer.
6. Code of Conduct
The organizers and speakers may exclude persons who engage or have engaged in racist, antisemitic, transphobic, sexist, or otherwise discriminatory behavior, belong to far-right or populist parties or organizations, are associated with extremist groups, or represent or act in accordance with nationalist or inhumane ideologies.
All participants must behave respectfully and professionally. The organizers reserve the right to refuse admission or exclude persons from the event who violate these rules or disrupt the proceedings.
7. Personal Belongings
Participants are responsible for their personal belongings. The organizers are not liable for loss, theft, or damage, except in cases of intent or gross negligence.
8. Photo and Video Recordings
During the event, the organizers or commissioned partners may take photos and video recordings. By participating in the event, participants consent to the use of images and audio recordings in which they are identifiable for documentation or promotional purposes on Instagram, LinkedIn, and/or TikTok in connection with the event.
Participants may object upon arrival; in this case, the organizers will endeavor to avoid recordings.
The creation and publication of photos or videos by participants is only permitted for private use. Commercial use or public distribution requires prior written consent from the organizers.
9. Data Protection
Personal data collected during registration is processed in compliance with applicable data protection laws, particularly the GDPR, and used exclusively for event-related purposes. If necessary for the event (e.g., to contact speakers or approve registrations), data may be shared with them. For further information, please refer to our privacy policy.
10. Liability
The organizers are fully liable for damages caused by intentional or negligent breaches of duty affecting life, body, or health.
For other damages, the organizers are only liable in cases of intent or gross negligence. In the case of minor negligence of essential contractual obligations (“cardinal obligations”), liability is limited to the foreseeable, typically occurring damage. Liability for indirect or consequential damages is excluded.
Liability for the content, statements, or actions of the speakers is excluded.
11. Cancellations and Refunds
Cancellations by participants must be made in writing. Refunds are only issued in justified exceptional cases or if the event is canceled without an alternative date being offered. In the event of changes in the schedule or cancellation of individual speakers, there is no entitlement to a refund as long as the event takes place as such.
No refund is provided in case of non-attendance.
12. No-Show Policy
If you register for a free event but fail to attend three times without prior notice, your access to future events may be suspended for up to six months.
13. Force Majeure
The organizers reserve the right to postpone or cancel the event in the event of force majeure (e.g., natural disasters, pandemics, official orders). Participants will be informed immediately; possible refunds or alternative dates will be provided accordingly.
If the minimum number of participants for an event is not reached, the organizers reserve the right to cancel the event and refund participants’ payments.
